Hit by an Uber or Lyft in Spring? Which insurance applies?

On Behalf of | Sep 3, 2026 | Car Accidents |

An Uber or Lyft crash can leave you dealing with injuries, vehicle damage and questions about which insurance company should cover your losses. In Spring, Texas, the insurance that may apply often depends on what stage of the ride the driver was in when the collision happened.

Texas law sets two main levels of required insurance, depending on where the driver was in the rideshare process.

How coverage changes with the driver’s status

For someone hit by a rideshare driver, these rules affect three practical stages:

  • Waiting for a request: If the driver is logged in and available but has not accepted a ride, Texas law requires at least $50,000 per person and $100,000 per crash for bodily injury or death, plus $25,000 for property damage.
  • Heading to a pickup: Under Texas law, a prearranged ride begins as soon as the driver accepts a ride request. From that point, the required insurance must provide a total limit of at least $1 million for death, bodily injury and property damage from each crash.
  • Carrying a passenger: The same $1 million total coverage requirement continues after pickup and lasts until the final requesting passenger leaves the vehicle.

A driver’s personal car insurance may exclude coverage while the vehicle is used for rideshare work. Depending on what the policies cover, the driver’s insurance, coverage maintained by Uber or Lyft or both may apply.

What information should you gather after a rideshare crash?

Evidence from the scene can help show what the driver was doing in the rideshare app and how the crash occurred. If you are able, consider gathering:

  • Photos of the vehicles, damage and surrounding area
  • The driver’s name, license and insurance information
  • Screenshots or trip details showing the Uber or Lyft ride
  • Contact information for witnesses
  • The police report number, if officers respond

Keep medical bills, repair estimates and other records tied to the crash as well.

What if insurers disagree about coverage?

Insurance disputes can add frustration when you are already dealing with the effects of a crash. Understanding which policy applies can help you avoid unnecessary delays. An attorney can review app records, insurance policies and other evidence to help clarify the available coverage and protect your financial recovery.
